WoodUpp's Standard Manufacturer's Limited Warranty

WoodUpp USA Inc. or any US-legal affiliates (“WoodUpp”) warrants that each Product will be manufactured in material compliance with the specifications provided by WoodUpp for such Product and will be free of any material defects in workmanship for the one (1) year period commencing on the day the Customer receives the order. This warranty does not apply to normal wear and tear and minor cosmetic damage that does not materially impact the use and performance of the Product. This warranty shall be null and void if the Product: (i) is not properly installed; (ii) is not used or maintained in strict conformance with the specifications applicable to such Product; (iii) was manufactured in accordance with any specifications or designs provided by the Customer or the Customer’s customer; or (iv) is damaged or fails due to a force majeure, accident, abuse or failure of a third party’s product used in conjunction with any Product. Variations in dye lots, gauges and textures, may occur which may vary slightly between the samples provided and the Product actually delivered, and no warranty is provided related to any such variations.  THIS IS A LIMITED WARRANTY. ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE ONE (1) YEAR PERIOD OF THIS WRITTEN WARRANTY. NO REPRESENTATION AND NO OTHER AFFIRMATION OF FACT WHICH IS NOT EXPRESSLY CONTAINED IN THIS WARRANTY WILL BE DEEMED TO BE A REPRESENTATION OR WARRANTY BY WOODUPP OR GIVE RISE TO ANY LIABILITY OF WOODUPP. TO THE EXTENT PERMITTED BY APPLICABLE LAW, WOODUPP IS NOT LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. FOR PURCHASES BY BUSINESS CUSTOMERS, CUSTOMER, HAVING THE EXPERTISE AND KNOWLEDGE IN THE INTENDED USE OF THE PRODUCTS, ASSUMES ALL RISK AND LIABILITY FOR RESULTS OBTAINED BY USE OF THE PRODUCTS BY ITS CUSTOMERS AND ANY OTHER USERS, WHETHER USED ALONE OR IN COMBINATION WITH OTHER MATERIALS OR PRODUCTS.

This warranty is incorporated by reference into WoodUpp's Terms and Conditions of Sale, which set out how to make a warranty claim and the remedies available. Separately from this warranty, our 100-Day Satisfaction Guarantee allows you to return your order within 100 days of receipt even if there is no defect.
